These Terms & Conditions apply to purchases made from Campbells Coffees, including purchases made through our website and orders placed directly with us.

​

Please read these terms carefully before placing an order. By placing an order with Campbells Coffees, you agree to be bound by these Terms & Conditions.

​

Nothing in these terms affects any statutory rights that cannot legally be excluded or restricted.

1. About Us

Campbells Coffees ("Campbells Coffees", "we", "us" or "our") supplies roasted coffee and related products to retail consumers and business/wholesale customers.

2. Consumers and Business Customers

Some provisions within these terms apply differently depending on whether you are purchasing as a Consumer or Business Customer.

A Consumer is an individual purchasing products wholly or mainly for purposes outside their trade, business, craft or profession.

A Business Customer is any individual, company, partnership, organisation or other entity purchasing products wholly or mainly for use within a trade, business, craft or profession.

This includes, but is not limited to, cafés, coffee shops, restaurants, hotels, offices, retailers, market traders and other wholesale customers.

Where an order is placed for business purposes, the provisions identified as applying to Business Customers will apply.

3. Products

We make every reasonable effort to ensure product descriptions, images, weights, origins, tasting notes, roast profiles and other information displayed on our website are accurate.

Coffee is, however, a natural agricultural product. Characteristics can vary between crops, harvests and batches.

Variations in appearance, bean size, colour, aroma, flavour and other natural characteristics do not necessarily constitute a defect.

Tasting notes are intended as a guide and are subjective. We cannot guarantee that every customer will experience exactly the same flavours or aromas described.

Product packaging and labels may occasionally differ from images displayed on our website without materially affecting the product supplied.

4. Coffee Preparation, Roasting and Grinding

Our coffee is roasted to provide fresh products to our customers.

Where grinding options are available, customers are responsible for selecting the appropriate grind type for their intended brewing equipment.

We cannot accept responsibility for an incorrectly selected grind option where the product supplied matches the option selected when the order was placed.

Coffee may naturally release gases following roasting. Customers should store coffee appropriately in a cool, dry place away from direct sunlight, moisture and strong odours.

5. Natural Materials, Stones and Foreign Objects

Coffee is an agricultural product which is harvested, processed and transported before roasting.

Quality-control and de-stoning processes are used to remove stones and other foreign material from coffee. These processes significantly reduce the risk of foreign material being present but cannot guarantee its complete elimination.

On rare occasions, small stones, fragments of natural material or other foreign objects may remain amongst coffee beans despite reasonable quality-control and de-stoning procedures.

We therefore recommend that customers visually inspect whole coffee beans before placing them into a grinder, particularly when using commercial, specialist or high-value grinding equipment.

If a customer discovers any suspected foreign material, they should:

​

  • stop using the affected coffee;

  • retain the foreign object where reasonably possible;

  • retain the affected coffee and its original packaging;

  • take clear photographs of the object and affected product; and

  • contact Campbells Coffees as soon as reasonably possible.

​

This allows us to investigate the matter and, where possible, trace the product concerned.

​

Business and Wholesale Customers

Business Customers acknowledge that coffee is a natural agricultural product and that, despite reasonable quality-control measures, the complete absence of naturally occurring foreign material cannot be guaranteed.

Business Customers are responsible for implementing appropriate checks and procedures before coffee is introduced into commercial grinding or processing equipment.

To the fullest extent permitted by law, Campbells Coffees shall not be liable to a Business Customer for indirect or consequential losses arising from foreign material within coffee, including loss of profit, loss of revenue, loss of business, loss of production or business interruption.

​

Any claim for alleged damage to machinery or equipment must be supported by reasonable evidence demonstrating the nature and cause of the damage.

​

Where reasonably possible, the suspected foreign object, affected coffee and packaging should be retained for inspection.

Where equipment damage is alleged, we may also request photographs, proof of purchase, service reports, repair quotations, invoices or an independent assessment before considering a claim.

Nothing in this section excludes or limits liability where doing so would be unlawful.

6. Orders

By placing an order, you confirm that the information provided by you is complete and accurate.

You are responsible for checking your order before submitting it, including:

  • product;

  • quantity;

  • bean or grind selection;

  • delivery address;

  • billing information; and

  • any other product options selected.

​

After an order is placed, changes may not always be possible because coffee may already have entered preparation, roasting, grinding, packing or dispatch.

​

Receipt of an order confirmation does not prevent us from cancelling an order where there has been an obvious pricing error, product availability issue, suspected fraud or other reasonable reason why we cannot fulfil the order.

If we cancel an order for which payment has already been received, we will refund the amount due.

7. Prices and Payment

Prices displayed on our website are shown in pounds sterling (£).

Delivery charges, where applicable, will be displayed during checkout or otherwise agreed before the order is confirmed.

Coffee is an internationally traded commodity and our costs may fluctuate. We therefore reserve the right to change our prices at any time.

Price changes will not normally affect an order that has already been accepted and paid for.

We make reasonable efforts to ensure pricing is accurate. If an obvious pricing error occurs, we reserve the right to cancel the affected order and provide a refund rather than supply goods at an obviously incorrect price.

Wholesale prices may be changed from time to time due to changes in green coffee prices, production costs, transport costs, currency movements and other commercial factors.

Unless otherwise agreed in writing, payment must be made according to the payment terms provided when the order is placed or invoiced.

8. Delivery

We aim to dispatch orders as quickly as reasonably possible.

Coffee may be roasted, ground, packed or otherwise prepared following receipt of an order, and dispatch times may therefore vary.

Any delivery dates or times provided are estimates unless expressly agreed otherwise.

We use third-party delivery companies and postal services. Once an order has been dispatched, circumstances outside our reasonable control may affect delivery.

Consumers will retain any delivery rights provided by applicable consumer law.

Customers are responsible for providing a complete and accurate delivery address.

We cannot accept responsibility for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer.

Additional costs incurred because an incorrect address was supplied may be charged to the customer where permitted by law.

9. Damaged, Missing or Incorrect Orders

Please inspect your order after delivery.

If products arrive damaged, incorrect or missing, please contact us as soon as reasonably possible and provide:

  • your order number;

  • details of the problem; and

  • photographs where appropriate.

​

Please retain the products and packaging until we have had an opportunity to investigate.

We may request further information before providing a replacement, refund or other remedy.

Nothing in this section affects a Consumer's statutory rights.

​

10. Consumer Returns and Cancellation Rights

If you purchase from us as a Consumer, you may have cancellation and return rights under applicable UK consumer law.

For goods where a statutory cancellation right applies, the standard cancellation period is normally 14 days from the day after the goods are received.

Certain products may be excluded from cancellation rights or may have restricted return rights where permitted by law, including products that are personalised, made to a customer's specification, liable to deteriorate or expire rapidly, or sealed for health or hygiene reasons and subsequently unsealed.

Because some coffee products may be prepared, ground, personalised or otherwise produced specifically for an order, cancellation rights may differ depending upon the particular product and circumstances.

This does not affect your rights where goods are faulty, damaged, not as described or otherwise fail to comply with your statutory rights.

Please contact us before returning any product so that we can provide appropriate instructions.

11. Faulty Products and Consumer Rights

Consumers are entitled to receive goods that are:

  • of satisfactory quality;

  • fit for their normal purpose; and

  • as described.

​

If a product does not meet these requirements, Consumers may have rights to a refund, repair, replacement or other remedy under the Consumer Rights Act 2015.

Nothing within these Terms & Conditions is intended to exclude, restrict or replace those statutory rights.

12. Wholesale and Business Orders

This section applies specifically to Business Customers.

Wholesale pricing and terms may be agreed separately with individual Business Customers.

Unless otherwise agreed in writing, wholesale orders are considered firm once accepted and may enter production or preparation shortly afterwards.

Business Customers should inspect goods promptly following delivery and notify us of any shortages, damage or obvious defects as soon as reasonably possible.

Where a defect could not reasonably have been identified upon delivery, the Business Customer should notify us promptly after discovering it.

We may require photographic evidence and/or the return of affected goods before issuing a credit, replacement or other remedy.

Returns of correctly supplied Business orders are not automatically accepted simply because the Business Customer no longer requires the goods.

Any return or credit for correctly supplied Business orders is at our discretion unless otherwise agreed in writing or required by law.

This does not affect rights which cannot lawfully be excluded.

13. Resale of Campbells Coffees Products

Business Customers purchasing Campbells Coffees products for resale are responsible for ensuring that products are stored, handled and sold appropriately.

Products must not be altered, relabelled, repackaged or presented in a misleading manner without our prior permission.

Any storage instructions, best-before information, allergen information or other legally required product information supplied with the products must not be removed, obscured or misrepresented.

Business Customers are responsible for ensuring that their own handling and sale of the products complies with applicable legal and regulatory requirements.

14. Subscriptions and Recurring Orders

Where we offer subscription or recurring-order services, the frequency, price and products included will be shown before the subscription is created.

By starting a paid subscription, you authorise us or our payment provider to take recurring payments according to the subscription selected.

Customers are responsible for ensuring subscription details remain correct, including delivery addresses, product selections and payment information.

Customers may cancel or amend subscriptions in accordance with the cancellation options and applicable rights presented with the subscription.

Any statutory cancellation or subscription rights available to Consumers remain unaffected.

15. Product Availability

All products are subject to availability.

Coffee availability can be affected by harvests, seasonal supply, international shipping, crop quality and other circumstances outside our reasonable control.

We may occasionally substitute packaging or make minor changes to products where this does not materially change the nature or quality of the product.

Where a product becomes unavailable after an order has been placed, we will contact the customer where appropriate and may offer an alternative or refund.

16. Limitation of Liability

  • Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability that cannot legally be excluded or limited.

Consumers

Nothing in these terms limits or excludes any statutory rights or remedies available to Consumers.

We are responsible for losses which are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill where applicable.

We are not responsible for business losses suffered by a Consumer where the products were purchased wholly or mainly for private use.

Business Customers

Subject to liabilities which cannot lawfully be excluded or limited, Campbells Coffees shall not be liable to Business Customers for:

  • loss of profit;

  • loss of sales or revenue;

  • loss of business;

  • loss of anticipated savings;

  • loss of goodwill;

  • business interruption; or

  • indirect or consequential loss.

​

Where permitted by law and reasonable in the circumstances, our total liability to a Business Customer arising from an individual order shall not exceed the total amount paid or payable to Campbells Coffees for the goods giving rise to the claim.

Nothing in this clause is intended to exclude liability where such exclusion would be unlawful or unreasonable under applicable law.

17. Events Outside Our Control

We will not be responsible for delays or failure to perform our obligations where caused by circumstances beyond our reasonable control.

Examples may include severe weather, transport disruption, postal or courier disruption, strikes, supplier interruption, crop failure, fire, flood, power failure, government action, international shipping disruption or other events outside our reasonable control.

We will take reasonable steps to minimise the effect of such events.

18. Complaints

We take complaints seriously and aim to resolve them fairly.

If you have a problem with an order or product, please contact us using the contact details displayed on our website.

Please provide your order number and as much information as reasonably possible so that we can investigate.

Where a complaint concerns product quality, contamination, foreign material or equipment damage, we may request that affected products, packaging and any foreign material are retained while the matter is investigated.

19. Website Use

The content of our website is provided for general information and for purchasing our products.

We make reasonable efforts to ensure website information is accurate and current but cannot guarantee that all information will always be free from errors.

We may update product information, prices, website content and these Terms & Conditions from time to time.

Unauthorised use of our website, including attempts to interfere with its operation or security, is prohibited.

20. Intellectual Property

Unless otherwise stated, website content including branding, logos, photographs, product descriptions, graphics and design elements is owned by or licensed to Campbells Coffees.

Content must not be reproduced, copied, distributed or commercially exploited without permission except where permitted by law.

"Campbells Coffees" branding and associated logos must not be used in a way that suggests endorsement, partnership or authorisation without our permission.

21. Privacy and Personal Information

We process personal information in accordance with our Privacy Policy and applicable data-protection legislation.

Personal information provided when placing an order will be used as reasonably necessary to process payment, prepare and fulfil orders, arrange delivery, provide customer service and meet our legal obligations.

22. Changes to These Terms

We may amend these Terms & Conditions from time to time.

The terms applicable to an order will normally be those in force when that order is placed, unless a change is required by law or otherwise agreed between us.

The latest version will be published on our website.

23. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

Where possible, an invalid provision will be treated as modified only to the extent necessary to make it lawful and enforceable.

24. No Waiver

If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.

25. Governing Law and Jurisdiction

These Terms & Conditions and any dispute or claim arising from them are governed by applicable UK law.

If you are a Consumer, you retain any rights you have regarding the courts in the part of the United Kingdom in which you live.

For Business Customers, unless otherwise agreed in writing and subject to applicable law, these Terms & Conditions and any dispute or claim arising from them shall be governed by the laws of England and Wales and the courts of England and Wales shall have jurisdiction.
